1. Scope

These Terms of Service ("Terms") govern the use of RedMatiq Online Services:

• AI Credits for cloud-based processing
• User accounts and dashboard
• Payment processing

2. Account and Responsibility

2.1 Account Creation

• Use of Online Services requires a user account
• You must be at least 18 years old or have parental/guardian consent
• Information provided during registration must be accurate

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials (email, verification code)
• All activities occurring under your account
• Promptly notifying us of any unauthorized use

Matiq GmbH is not liable for damages resulting from unauthorized use of your account.

3. AI Credits and Payments

3.1 Credit Purchase

• AI Credits are purchased to use Cloud-AI features
• The price per Credit is displayed in the dashboard
• Credits are non-transferable and non-refundable (except where required by law)

3.2 Immediate Execution and Right of Withdrawal

When purchasing AI Credits, you confirm:

☑ "I agree that the contract shall be performed immediately, and I acknowledge that I lose my right of withdrawal once performance begins."

By consenting, you waive your 14-day right of withdrawal for purchased Credits.

4. Prohibited Uses

When using Cloud-AI features, the following is prohibited:

• Generation of illegal, harmful, or abusive content
• Use for fraud, identity theft, or harassment
• Circumvention of technical protection measures
• Automated mass requests without authorization

Consequences: Matiq GmbH reserves the right to suspend or delete accounts for violations, without refund of previously purchased Credits.

5. Availability and Support

• Online Services are provided on an "as available" basis
• Scheduled maintenance will be announced in advance
• No guarantee of uninterrupted service

6. Limitation of Liability

Matiq GmbH's liability for damages from use of Online Services is limited to:

• The value of Credits purchased in the last 12 months
• Excluded: intentional misconduct and gross negligence

7. Changes to Terms

Matiq GmbH may modify these Terms at any time. Changes will be:

• Announced by email at least 14 days before taking effect
• In case of non-acceptance: account cancellation is possible (no refund of existing Credits)

8. Governing Law and Jurisdiction

• Governing Law: Swiss law
• Jurisdiction: Zurich, Switzerland
